This Privacy Policy explains how Temamila Group LLC, doing business as SmartDeal365 ("SmartDeal365," "we," "us," or "our"), collects, uses, shares, and protects personal information when you visit https://smartdeal365.com (the "Platform"), submit a form, join our buyers list, inquire about a deal, submit a deal to us, or otherwise communicate with us.

By using the Platform, you agree to this Privacy Policy. This policy should be read together with our Terms of Service, Communications Consent Policy, and Disclaimer.

1. Information We Collect

1.1. Information you provide to us

  • Contact information: name, email address, phone number, city and state, preferred contact method.
  • Buy Box and investment criteria: target markets, property types, strategies (for example, Subject-To, Seller Financing, Novation, Wholesale, Fix & Flip, Buy & Hold, STR, co-living), price range, entry fee range, desired returns, timeline, and experience level.
  • Deal inquiries: the property you are interested in, your questions, and your offer details.
  • Deal submissions: property address, contract details, seller-related information, photos, documents, and links you share with us (for example, Google Drive links).
  • Verification information: proof of funds, company/entity name, and similar information we may request before sharing detailed deal information.
  • Communications: the content of emails, text messages, calls, chats, and Zoom sessions with our team.

1.2. Consent records

When you agree to receive communications from us, we record the date and time of your consent, the IP address and device/browser information used, the page on which consent was given, and the exact consent language shown to you. We keep these records to document your consent and to comply with the law.

1.3. Information collected automatically

  • IP address, browser type, device type, operating system, referring URL, pages viewed, and time spent on the Platform.
  • Cookies, pixels, and similar technologies (see Section 6).

1.4. Information from other sources

We may receive information about you from Deal Partners, joint venture partners, referral partners, event registrations, social media platforms where you contacted us, and publicly available sources.

2. How We Use Your Information

We use personal information to:

  • provide and operate the Platform and our buyers list;
  • match and send you deals that may fit your Buy Box;
  • respond to your inquiries, offers, and requests;
  • evaluate, market, and close deals, including coordinating with title companies, closing attorneys, and transaction coordinators;
  • evaluate deal submissions and joint venture opportunities;
  • send you transactional and marketing communications by email, text message (SMS/MMS), and phone, only as permitted by your consent and applicable law;
  • verify identity, proof of funds, and prevent fraud, abuse, and circumvention;
  • improve the Platform, analyze usage, and develop new features;
  • keep records of consent and opt-out requests;
  • comply with legal obligations and enforce our Terms of Service.

3. How We Share Your Information

We do not sell your personal information.

We may share personal information only as follows:

  • Service providers who help us operate our business (for example, website hosting, CRM, email and SMS delivery, telephony, cloud storage, analytics, and scheduling), bound by obligations to use the information only to provide services to us.
  • Transaction parties as needed to complete a deal you are pursuing, such as sellers, Deal Partners, joint venture partners, title and escrow companies, closing attorneys, and transaction coordinators.
  • Affiliates under common control with SmartDeal365, for the purposes described in this policy.
  • Legal and safety: to comply with law, subpoena, or court order; to protect the rights, property, or safety of SmartDeal365, our users, or others; or to enforce our agreements.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.
  • With your consent or at your direction.

3.1. Mobile information and SMS consent

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except with service providers (such as our SMS platform and phone carriers) solely as necessary to deliver messages to you.

4. Your Choices

  • Email: click "unsubscribe" in any marketing email, or email info@smartdeal365.com.
  • Text messages: reply STOP to any message to opt out. Reply HELP for help.
  • Calls: tell our team during a call that you do not wish to be called again, or email info@smartdeal365.com.
  • Buyers list removal: email info@smartdeal365.com with the subject "Remove me," and we will remove you from our buyers list and marketing communications.

We will process opt-out requests promptly and within the time required by law. We may still send you non-marketing messages related to an active transaction you are part of, and we may keep a record of your opt-out so we can honor it.

5. Your Privacy Rights

Depending on your state of residence, you may have the right to:

  • request access to the personal information we hold about you;
  • request correction of inaccurate information;
  • request deletion of your personal information;
  • opt out of targeted advertising, sale, or profiling (we do not sell personal information);
  • appeal our decision on your request.

We will not discriminate against you for exercising your rights. We and our service providers may use cookies, pixels, and similar technologies to operate the Platform, remember your preferences, understand how visitors use the Platform, and measure the effectiveness of our advertising (for example, through analytics and advertising pixels such as Google or Meta). You can control cookies through your browser settings. Disabling cookies may affect certain features of the Platform. Some browsers send "Do Not Track" signals; because there is no common standard for these signals, the Platform does not currently respond to them, but we honor legally recognized opt-out preference signals where required by law.

We keep personal information for as long as needed for the purposes described in this policy, including maintaining the buyers list, completing and documenting transactions, keeping consent and opt-out records, resolving disputes, and meeting legal, tax, and accounting obligations. When information is no longer needed, we delete or de-identify it.

However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security. Please do not send highly sensitive information (such as full Social Security numbers or bank account numbers) through Platform forms, email, or text message.

The Platform is intended only for adults 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us and we will delete it.

10. Information Submitted About Other People

If you submit information about another person (for example, a seller, partner, or co-buyer), you represent that you have the right and, where required, the consent to provide that information to us. Do not submit a form on behalf of another person without their authorization.

The Platform may contain links to third-party websites and services. We are not responsible for their privacy practices. Please review their privacy policies.

12. Users Outside the United States

The Platform is operated in the United States and intended for users interested in U.S. real estate. If you access the Platform from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.
